in plain englishAI-generated · not legal advice

Federal credit unions must pay the Administration an annual operating fee. The Board sets the fee and payment rules, and the money is deposited, spent, and sometimes invested for the Administration.

(a) Payment by Federal credit union to Administration. Under Board rules, each Federal credit union must pay the Administration an annual operating fee. The fee may contain one or more charges identified by the function or functions being funded.
(b) Determinations of amount, assessment periods, and payment dates. The Board must set the fee by a schedule, schedules, or another suitable method. It must consider the Administration’s expenses in performing its duties under this chapter and Federal credit unions’ ability to pay. The Board must also set the assessment periods and payment dates or installment dates.
(c) Supervision charge exception; waiver of payment. If the fee has separate charges, no supervision charge is due in the year the credit union’s charter is issued, final liquidation distribution is made, or the charter is canceled. The Board may waive some or all other charges for that year.
(d) Payment into Treasury of United States. All operating fees must be deposited with the Treasurer of the United States for the Administration’s account. The Board may spend them on expenses of carrying out this chapter, including examining and supervising Federal credit unions.
(e) Investment of annual operating fees not needed for current operations.
(1) At the Board’s request, the Treasury Secretary must invest and reinvest portions of the deposited fees that the Board decides are not needed for current operations.
(2) The investments may be only interest-bearing United States securities with maturities requested by the Board. The Treasury Secretary sets the interest rates, considering current market yields on comparable outstanding marketable United States obligations.
(3) Income from the investments and reinvestments must be deposited into the Administration’s account under subsection (d).

(b) Determinations of amount, assessment periods, and payment dates

(c) Supervision charge exception; waiver of payment

If the annual operating fee is composed of separate charges, no supervision charge shall be payable by a Federal credit union, and the Board may waive payment of any or all other charges comprising the fee, with respect to the year in which its charter is issued, or in which final distribution is made in its liquidation or the charter is canceled.
