14 U.S.C. § 2501 — Grade on retirement
submitted 63 years ago by Pub. L. 88-130 to r/title-14-COAST-GUARD · 793 words · no verdicts yet
This section sets the retired grade for Coast Guard commissioned and warrant officers based on the highest grade in which satisfactory service lasted at least six months. It provides rules for misconduct, investigations, reopening decisions, notice and response, retired-pay recalculation, and excludes commissioned warrant officers.
(a) Commissioned officers.
(1) In general. A commissioned officer retired under any provision of this title must be retired from active service in the highest grade the officer held for at least six months on active duty in which the Secretary* decides the officer’s performance was satisfactory.
(2) Conditional determination. If an officer is being investigated for alleged misconduct when retiring—
(A) the Secretary may conditionally decide the highest grade in which the officer’s service was satisfactory while the investigation is pending; and
(B) the grade under subparagraph (A) is subject to resolution under subsection (c)(2).
(b) Warrant officers. A warrant officer retired under section 580, 1263, 1293, or 1305 of title 10 must be retired from active service in the highest commissioned grade above chief warrant officer, W–4, that the officer held for at least six months on active duty in which the Secretary decides the officer’s performance was satisfactory.
(c) Retirement in a lower grade.
(1) Misconduct in a lower grade. If the Secretary decides a commissioned officer committed misconduct in a lower grade, the Secretary may decide that the officer did not serve satisfactorily in any grade equal to or higher than that lower grade.
(2) Adverse findings. After a conditional decision under subsection (a)(2), the officer’s retired grade must be resolved if the investigation or personnel action produces adverse findings.
(3) Recalculation of retired pay. If this subsection lowers the officer’s retired grade, the officer’s retired pay must be recalculated under chapter 71 of title 10. Any change takes effect on the date the lower retired grade takes effect.
(d) Finality of retired-grade decisions.
(1) In general. Except as paragraph (2) provides, a decision under this section about a commissioned officer’s retired grade becomes administratively final on the retirement date and may not be reopened.
(2) Reopening decisions. The decision may be reopened if—
(A) fraud obtained the officer’s retirement or retired grade;
(B) after retirement, substantial evidence appears that could have led to a lower grade and was unknown to a competent authority at retirement;
(C) substantial evidence appears that, during commissioned service, the officer failed to carry out applicable laws with intent to deceive or defraud;
(D) after retirement, substantial evidence appears that the officer committed rape or sexual assault, as described in sections 920(a) and 920(b) of title 10, at any time during commissioned service;
(E) after retirement, substantial evidence appears that the officer knew about and failed to report through proper channels, as required by the law existing when the incident allegedly occurred, a known sexual assault by a Coast Guard member under the officer’s command during the officer’s service;
(F) the decision contained a mistake of law or calculation;
(G) for a retired grade following a conditional decision under subsection (a)(2), the investigation or personnel action produces adverse findings; or
(H) the Secretary decides under regulations prescribed by the Secretary that good cause exists to reopen it.
(3) Requirements. If a decision is reopened under paragraph (2), the Secretary—
(A) must notify the officer; and
(B) may not make an adverse decision about the retired grade until the officer has had a reasonable chance to respond about the reason for reopening.
(4) Recalculation of retired pay. If reopening under paragraph (2) lowers the officer’s retired grade, retired pay must be recalculated under chapter 71 of title 10. Any change takes effect on the date the lower retired grade takes effect.
(e) No application to commissioned warrant officers. This section, including subsection (b), does not apply to commissioned warrant officers.
A commissioned officer who is retired under any provision of this title, shall be retired from active service with the highest grade held by the commissioned officer for not less than six months while on active duty in which, as determined by the Secretary*, the commissioned officer’s performance of duty was satisfactory.
When a commissioned officer is under investigation for alleged misconduct at the time of retirement—
the Secretary may conditionally determine the highest grade of satisfactory service of the commissioned officer pending completion of the investigation; and
the grade under subparagraph (A) is subject to resolution under subsection (c)(2).
Any warrant officer who is retired under any provision of section 580, 1263, 1293, or 1305 of title 10, shall be retired from active service with the highest commissioned grade above chief warrant officer, W–4, held by the warrant officer for not less than six months on active duty in which, as determined by the Secretary, the warrant officer’s performance of duty was satisfactory.
In the case of a commissioned officer whom the Secretary determines committed misconduct in a lower grade, the Secretary may determine the commissioned officer has not served satisfactorily in any grade equal to or higher than that lower grade.
A determination of the retired grade of a commissioned officer shall be resolved following a conditional determination under subsection (a)(2) if the investigation of or personnel action against the commissioned officer results in adverse findings.
If the retired grade of a commissioned officer is reduced pursuant to this subsection, the retired pay of the commissioned officer shall be recalculated under chapter 71 of title 10, and any modification of the retired pay of the commissioned officer shall go into effect on the effective date of the reduction in retired grade.
Except as provided in paragraph (2), a determination of the retired grade of a commissioned officer under this section is administratively final on the day the commissioned officer is retired, and may not be reopened.
A determination of the retired grade of a commissioned officer may be reopened if—
the retirement or retired grade of the commissioned officer was procured by fraud;
substantial evidence comes to light after the retirement that could have led to a lower retired grade under this section and such evidence was not known by a competent authority at the time of retirement;
substantial evidence comes to light that, during the commissioned service of the officer, the officer failed to carry out applicable laws, with an intent to deceive or defraud;
substantial evidence comes to light after the retirement that the officer committed rape or sexual assault, as described in sections 920(a) and 920(b) of title 10 (articles 120(a) and 120(b) of the Uniform Code of Military Justice) at any time during the commissioned service of the officer;
substantial evidence comes to light after the retirement that the commissioned officer knew of and failed to report through proper channels, in accordance with existing law at the time of the alleged incident, any known instances of sexual assault by a member of the Coast Guard under the command of the officer during the officer’s service;
a mistake of law or calculation was made in the determination of the retired grade;
in the case of a retired grade following a conditional determination under subsection (a)(2), the investigation of or personnel action against the commissioned officer results in adverse findings; or
the Secretary determines, under regulations prescribed by the Secretary, that good cause exists to reopen the determination.
If a determination of the retired grade of a commissioned officer is reopened under paragraph (2), the Secretary—
shall notify the commissioned officer of the reopening; and
may not make an adverse determination on the retired grade of the commissioned officer until the commissioned officer has had a reasonable opportunity to respond regarding the basis of the reopening.
If the retired grade of a commissioned officer is reduced through the reopening of the commissioned officer’s retired grade under paragraph (2), the retired pay of the commissioned officer shall be recalculated under chapter 71 of title 10, and any modification of the retired pay of the commissioned officer shall go into effect on the effective date of the reduction in retired grade.
This section, including subsection (b), shall not apply to commissioned warrant officers.
