15 U.S.C. § 1063 — Opposition to registration

submitted 80 years ago by ch. 540 to r/title-15-COMMERCE-AND-TRADE · 262 words · no verdicts yet

in plain englishAI-generated · not legal advice

A person who believes registration of a mark would damage them may oppose the registration within the stated deadlines. If no successful opposition occurs, the mark is registered or the applicant receives a notice of allowance, depending on the application.

(a) A person who believes registration of a mark on the principal register would damage that person—including because the mark would likely cause dilution by blurring or tarnishment—may pay the required fee and file an opposition with the Patent and Trademark Office. The opposition must state its grounds and be filed within 30 days after publication under section 1062(a). A written request made before that period ends adds 30 days. The Director may grant further extensions for good cause if requested before an extension ends, and must notify the applicant of each extension. The Director may set conditions for amending an opposition.

(b) Unless the opposition succeeds: (1) a mark entitled to registration based on an application under section 1051(a) or 1126 is registered, a registration certificate is issued, and notice is published in the Official Gazette; or (2) if the application was filed under section 1051(b), the applicant receives a notice of allowance.
