This section defines "antitrust laws," "commerce," and "person" for the Clayton Act. It also names the law the "Clayton Act." These definitions set the reach of the whole statute.

(a) This subsection defines three terms. "Antitrust laws" includes the Sherman Act (approved July 2, 1890), sections 73 through 76 of an 1894 tax and revenue act, a 1913 act amending sections 73 and 76 of that 1894 act, and this Act itself. "Commerce" means trade or commerce among the states, with foreign nations, between D.C. or a Territory and any state, territory, or foreign nation, between insular possessions or other U.S.-controlled places, between such a possession and a state, territory, D.C., or foreign nation, or within D.C., a Territory, an insular possession, or another place under U.S. jurisdiction. This Act does not apply to the Philippine Islands. The word "person" or "persons," wherever it appears in this Act, includes corporations and associations that exist under, or are authorized by, the laws of the United States, of any Territory, of any State, or of any foreign country. (b) This Act's official short title is the "Clayton Act."
