submitted 46 years ago by Pub. L. 96-399 to r/title-15-COMMERCE-AND-TRADE · 151 words · no verdicts yet
This section gives Federal and State courts concurrent jurisdiction over actions under this chapter and sets venue and service rules. It generally bars removal of those cases from State court, with one stated exception.
Federal district courts, territorial United States courts, and the United States District Court for the District of Columbia have jurisdiction under this chapter, concurrently with State courts, over legal and equitable actions under it, without regard to the amount at stake. An action may be brought where the defendant is found, lives, or does business, or where the sale occurred. Process may be served in other districts where the defendant lives or wherever the defendant is found. A case under this chapter brought in a competent State court may not be removed to a United States court unless a United States officer or employee is a party in an official capacity.
The district courts of the United States, the United States courts of any territory, and the United States District Court for the District of Columbia shall have jurisdiction under this chapter and, concurrent with State courts, of actions at law or in equity brought under this chapter without regard to the amount in controversy. Any such action may be brought in the district wherein the defendant is found or is an inhabitant or transacts business, or in the district where the sale took place, and process in such cases may be served in other districts of which the defendant is an inhabitant or wherever the defendant may be found. No case arising under this chapter and brought in any State court of competent jurisdiction shall be removed to any court of the United States, except where any officer or employee of the United States in his official capacity is a party.
