16 U.S.C. § 410sss — Harriet Tubman Underground Railroad National Historical Park, Maryland

(a) Definitions: This section defines "historical park" as the park created by subsection (b)(1)(A); "map" as the official boundary map dated March 2014; "Secretary" as the Secretary of the Interior; and "State" as Maryland. (b) Harriet Tubman Underground Railroad National Historical Park: (1) Establishment: (A) The park is created as a National Park System unit in Maryland, covering the area shown on the map. (B) The park's boundary is that mapped land plus any land added later under the acquisition rules. (C) The map must be on file and open for public inspection at National Park Service offices. (2) Purpose: The park exists to protect and explain, for people now and later, the historical, cultural, and natural resources tied to Harriet Tubman's life and the Underground Railroad. (3) Land acquisition: (A) The Secretary may get land inside the mapped "Authorized Acquisition Areas" only by buying from a willing seller, by donation, or by trade. (B) The Secretary cannot force a sale through condemnation. (C) Once land is acquired, the park's boundary is updated to include it. (c) Administration: (1) The Secretary must run the historical park together with the part of the Harriet Tubman Underground Railroad National Monument the National Park Service manages, as one single unit called the "Harriet Tubman Underground Railroad National Historical Park." (2) The Secretary must follow this section, Presidential Proclamation 8943, and the general laws for National Park System units, including the National Park System Organic Act and the Historic Sites Act of 1935. (3) Within one year of December 19, 2014, the Directors of the National Park Service and the U.S. Fish and Wildlife Service must agree on how the Park Service can do archeological research and public interpretation of Tubman-related historic sites inside the Blackwater National Wildlife Refuge, while still following the Refuge's own management rules. (4) The Secretary may offer guided tours to Tubman- and Underground Railroad-related sites outside the park's boundary, in Caroline, Dorchester, and Talbot Counties, Maryland. (5) This section does not change: (A) land inside the Blackwater National Wildlife Refuge; (B) existing agreements between the Secretary and private landowners about hunting, fishing, farming, or other activities; or (C) private property owners' land-use rights inside or next to the park or the national monument, including activities that can be seen or heard from inside the park or monument. (6) Agreements: (A) The Secretary may make agreements with Maryland, its local governments, colleges, nonprofits, and individuals to mark, interpret, and restore historic or cultural resources tied to Tubman or the Underground Railroad inside the park (if the agreement allows reasonable public access), or to do related research. (B) The Secretary may agree to build, run, and maintain a joint visitor center on State-owned land, giving the Park Service visitor and interpretive space plus free office space for running the park. (C) The federal share of any activity's cost under this paragraph cannot exceed 50%; the rest can come from in-kind contributions or fairly valued goods and services. (d) General management plan: (1) Within 3 years of when money becomes available for this section, the Secretary must write a general management plan following section 100502 of title 54. (2) The plan must be written together with Maryland and its local governments. (3) The Secretary must hold at least one public meeting on the draft plan and allow comment, and must also post the draft plan online for public comment. (4) The Secretary must coordinate the plan with the Blackwater National Wildlife Refuge, the Harriet Tubman National Historical Park (in New York, established by section 410ttt), and the National Underground Railroad Network to Freedom.
