18 U.S.C. § 2261A — Stalking

Whoever does either of the following is punished under § 2261(b) or § 2261B, as applicable: (1) travels in interstate or foreign commerce, is in the United States’s special maritime and territorial jurisdiction, or enters or leaves Indian country^*, intending to kill, injure, harass, intimidate, or surveil another person with that intent, and during or because of that travel or presence engages in conduct that (A) places that person in reasonable fear of death or serious bodily injury^* to (i) that person, (ii) an immediate family member as defined in § 115, (iii) a spouse or intimate partner^*, or (iv) the person’s pet^*, service animal^*, emotional support animal^*, or horse, or (B) causes, attempts to cause, or would reasonably be expected to cause substantial emotional distress to a person in clauses (i), (ii), or (iii); or (2) with the same intent, uses the mail, an interactive computer or electronic communication service, an electronic communication system of interstate commerce, or another interstate or foreign commerce facility to engage in a course of conduct^* that (A) places the person in reasonable fear of death or serious bodily injury^* to a person or animal described in paragraph (1)(A), or (B) causes, attempts to cause, or would reasonably be expected to cause substantial emotional distress to a person described in paragraph (1)(A)(i), (ii), or (iii).
