submitted 52 years ago by Pub. L. 93-344 to r/title-2-THE-CONGRESS · 356 words · no verdicts yet
Until a concurrent budget resolution is agreed to, the House and Senate generally may not consider legislation that first changes budget authority, revenues, debt limits, entitlement authority, or outlays for covered fiscal years. The section lists House and Senate exceptions, including advance appropriations.
(a) General rule. Until the concurrent budget resolution for a fiscal year is agreed to, the House may not consider, for the resolution's first fiscal year, and the Senate may not consider, for any fiscal year covered by it, a bill or joint resolution, an amendment or motion to one, or a conference report on one that (1) first provides new budget authority; (2) first increases or decreases revenues; (3) increases or decreases the public-debt limit effective during that year; (4) in the Senate, first provides new entitlement authority; or (5) in the Senate, first increases or decreases outlays.
(b) House exceptions. Subsection (a) does not apply in the House (1)(A) to a reported bill or joint resolution providing advance discretionary new budget authority first available in the first or second fiscal year after the budget year, or (B) to a reported bill or joint resolution first changing revenues in a fiscal year after the one covered by the resolution; (2) after May 15, to a general appropriation bill or amendment; or (3) to a bill or joint resolution unless a committee reported it.
(c) Senate appropriation measures. (1) Until the budget resolution is agreed to and the Senate Appropriations Committee receives an allocation under section 633(a) for that year, the Senate may not consider an appropriation bill or joint resolution, amendment or motion to one, or conference report on one for that year or a later year. (2) This does not apply to appropriations making advance appropriations for the first or second fiscal year after the year of the allocation.
Until the concurrent resolution on the budget for a fiscal year has been agreed to, it shall not be in order in the House of Representatives, with respect to the first fiscal year covered by that resolution, or the Senate, with respect to any fiscal year covered by that resolution, to consider any bill or joint resolution, amendment or motion thereto, or conference report thereon that—
first provides new budget authority for that fiscal year;
first provides an increase or decrease in revenues during that fiscal year;
provides an increase or decrease in the public debt limit to become effective during that fiscal year;
in the Senate only, first provides new entitlement authority for that fiscal year; or
in the Senate only, first provides for an increase or decrease in outlays for that fiscal year.
In the House of Representatives, subsection (a) does not apply—
to any bill or joint resolution, as reported, providing advance discretionary new budget authority that first becomes available for the first or second fiscal year after the budget year; or
to any bill or joint resolution, as reported, first increasing or decreasing revenues in a fiscal year following the fiscal year to which the concurrent resolution applies;
after May 15, to any general appropriation bill or amendment thereto; or
to any bill or joint resolution unless it is reported by a committee.
Until the concurrent resolution on the budget for a fiscal year has been agreed to and an allocation has been made to the Committee on Appropriations of the Senate under section 633(a) of this title for that year, it shall not be in order in the Senate to consider any appropriation bill or joint resolution, amendment or motion thereto, or conference report thereon for that year or any subsequent year.
Paragraph (1) does not apply to appropriations legislation making advance appropriations for the first or second fiscal year after the year the allocation referred to in that paragraph is made.
