For most of this chapter, an “institution of higher education” is a qualifying public or nonprofit educational institution. The section also includes certain one-year training schools and dual-enrollment institutions and requires the Secretary to publish a list of reliable accrediting agencies.

(a) For this chapter other than subchapter IV, “institution of higher education” means an educational institution in a State that: (1) admits as regular students only people with a secondary-school graduation certificate or recognized equivalent, or people meeting section 1091(d); (2) is legally authorized in the State to provide education beyond secondary school; (3) awards a bachelor’s degree, provides at least a two-year program acceptable for full credit toward one, or awards a degree acceptable for admission to a graduate or professional program, subject to the Secretary’s review and approval; (4) is public or nonprofit; and (5) is accredited by a nationally recognized accrediting agency or association, or has preaccreditation from one recognized by the Secretary and the Secretary finds reasonable assurance that it will meet that agency’s standards in a reasonable time. (b) It also includes: (1) a school providing at least a one-year program preparing students for gainful employment in a recognized occupation and meeting subsection (a)(1), (2), (4), and (5); and (2) a public or nonprofit private institution that instead admits regular students who are beyond the State’s compulsory-school-attendance age or who will be dually or concurrently enrolled there and in secondary school. (c) For this section and section 1002, the Secretary must publish the nationally recognized accrediting agencies or associations that the Secretary determines under subchapter IV, part H, subpart 2, to be reliable authorities on the quality of offered education or training.
