submitted 34 years ago by Pub. L. 87-195 to r/title-22-FOREIGN-RELATIONS-AND-INTERCOURSE · 197 words · no verdicts yet
New obligations issued by a beneficiary country must carry interest at a concessional rate. The interest is paid either in local currency into an Americas Fund or in U.S. dollars into the applicable government account, and previously paid interest is not redeposited if an agreement is later made.
(a) Interest rate. New obligations issued by a beneficiary country* under section 2430c(b) of this title must bear interest at a concessional rate.
(b) Payment currency and deposits.
(1) Local currency. If the beneficiary country has entered into an Americas Framework Agreement*, it must pay interest in its local currency and deposit it in an Americas Fund*. The interest remains the country’s property until it is paid out under section 2430f(d) of this title. The local currency must be used for the purposes stated in the agreement.
(2) U.S. dollars. If the beneficiary country has not entered into an Americas Framework Agreement, it must pay interest in U.S. dollars and deposit it in the U.S. Government account established for interest payments on the obligations exchanged for the new obligations.
(c) Interest already paid. If a beneficiary country enters into an Americas Framework Agreement after interest on the new obligation first became due, interest already paid on that obligation must not be redeposited into that country’s Americas Fund.
New obligations issued by a beneficiary country* pursuant to section 2430c(b) of this title shall bear interest at a concessional rate.
If the beneficiary country has entered into an Americas Framework Agreement*, interest shall be paid in the local currency of the beneficiary country and deposited in an Americas Fund*. Such interest shall be the property of the beneficiary country, until such time as it is disbursed pursuant to section 2430f(d) of this title. Such local currencies shall be used for the purposes specified in the Americas Framework Agreement.
If the beneficiary country has not entered into an Americas Framework Agreement, interest shall be paid in United States dollars and deposited in the United States Government account established for interest payments of the obligations for which the new obligations were exchanged.
If a beneficiary country enters into an Americas Framework Agreement subsequent to the date on which interest first became due on the newly issued obligation, any interest already paid on such new obligation shall not be redeposited into the Americas Fund established for that country.
