submitted 72 years ago by ch. 736 to r/title-26-INTERNAL-REVENUE-CODE · 68 words · no verdicts yet
When someone obtains the right to sell an article from its manufacturer, producer, or importer through a non-taxable transaction or operation of law, that person’s sale is taxed as the original seller’s sale. The section states these rules.
If a person obtains from the manufacturer, producer, or importer the right to sell an article through operation of law or a transaction not taxed under this chapter, that person’s sale is taxable as though the original manufacturer, producer, or importer made it, and that person owes the tax.
In case any person acquires from the manufacturer, producer, or importer of an article, by operation of law or as a result of any transaction not taxable under this chapter, the right to sell such article, the sale of such article by such person shall be taxable under this chapter as if made by the manufacturer, producer, or importer, and such person shall be liable for the tax.
