This section limits appropriations to the purposes for which Congress made them, unless another law provides otherwise. It also sets rules for treating diverted balances, permanent appropriations, and contracts that exceed an appropriation.

(a) An appropriation may be used only for the purposes for which it was made, unless a law provides otherwise.

(b) Reusing or diverting an unspent appropriation balance for a purpose different from the original purpose is treated and recorded as a new appropriation. The unspent balance must be reduced by the amount diverted.

(c) An appropriation in a regular annual appropriation law may be treated as permanent or continuously available only if: (1) it is for rivers and harbors, lighthouses, public buildings, or the pay of the Navy and Marine Corps; or (2) the law expressly says it is available after the fiscal year covered by the law.

(d) A law may be treated as making an appropriation from the Treasury, or as authorizing a contract to pay more money than an appropriation provides, only if the law specifically says that an appropriation is made or that such a contract may be made.

(2)

expressly provides that it is available after the fiscal year covered by the law in which it appears.

(d)

A law may be construed to make an appropriation out of the Treasury or to authorize making a contract for the payment of money in excess of an appropriation only if the law specifically states that an appropriation is made or that such a contract may be made.
