Six months after November 18, 1988, public vessels generally may not put potentially infectious medical waste into ocean waters. Exceptions require a threat aboard or war/emergency, distance beyond 50 nautical miles, and specified treatment, packaging, and weighting.

After six months following November 18, 1988, no public vessel may dispose of potentially infectious medical waste into ocean waters unless (1)(A) people aboard face a health or safety threat, or (B) it is wartime or a declared national emergency; (2) disposal is beyond 50 nautical miles from nearest land; and (3)(A) a nonsubmersible vessel sterilizes, properly packages, and sufficiently weights the waste to prevent it coming ashore, or (B) a submersible properly packages and sufficiently weights it for that purpose.
