41 U.S.C. § 8702 — Prohibited conduct

This section prohibits giving, seeking, or charging kickbacks in covered government-contract relationships.
A person* may not (1) give, try to give, or offer to give a kickback*; (2) ask for, accept, or try to accept a kickback; or (3) put a prohibited kickback amount into the contract price that (A) a subcontractor* charges a prime contractor* or higher-tier subcontractor, or (B) a prime contractor charges the Federal Government.
A person* may not—
provide, attempt to provide, or offer to provide a kickback*;
solicit, accept, or attempt to accept a kickback; or
include the amount of a kickback prohibited by paragraph (1) or (2) in the contract price—
a subcontractor* charges a prime contractor* or a higher tier subcontractor; or
a prime contractor charges the Federal Government.
