The Commission’s indemnity obligation applies only if both employment and community population stayed below specified levels for the six months before the claim. Employment is measured using pay periods near the 15th of each month.

The indemnity described in § 2363 arises only if, during the six months immediately before it is invoked: (a) Commission-determined operating, maintenance, and administrative employment in the project area was below 14,337 at Oak Ridge, 7,622 at Richland, or 4,620 at Los Alamos; and (b) community population was below 29,250 at Oak Ridge, 25,200 at Richland, or 11,769 at Los Alamos. For this section, employment is determined from the pay period or periods ending closest to the 15th of each month.
