42 U.S.C. § 280f — Fetal alcohol spectrum disorders prevention, intervention, and services delivery program

(a) In general. The Secretary must establish or continue a comprehensive fetal alcohol spectrum disorders (called "FASD" in this section) education, prevention, identification, intervention, and services program, which may include: (1) an education and public awareness effort that supports, runs, and checks the results of (A) training programs for health, social-service, education, and other providers on preventing, identifying, and helping people with FASD; (B) ways to teach school-age children, including pregnant and high-risk youth, about FASD; (C) public and community awareness programs about FASD; and (D) ways to coordinate information and services across agencies — including social-service agencies like foster care and adoption, health agencies, and education, job-training, and justice agencies; (2) supporting and conducting research on FASD, including to (A) develop better medical ways to diagnose FASD, and (B) develop effective, culturally and linguistically appropriate interventions and supports to prevent drinking during pregnancy, even where that co-occurs with other substance use; (3) building state and tribal ability to identify, treat, and support people with FASD and their families, which may include (A) adapting existing federal, state, or tribal programs to add FASD identification and informed support, (B) expanding screening and diagnostic capacity, (C) building, running, and evaluating targeted FASD intervention programs, (D) training professionals across relevant fields on FASD, and (E) spreading information about FASD and support services; and (4) an applied research program on intervention and prevention, supporting service demonstration projects, clinical studies, and other models offering advocacy, education, job training, counseling, and medical or mental-health services — including models that combine and coordinate these services — aimed at the specific challenges facing people with fetal alcohol spectrum disorder or fetal alcohol effect, and their families. (b) Grants and technical assistance. (1) In general: the Secretary may award grants, cooperative agreements, and contracts, and give technical assistance, to eligible entities to carry out subsection (a). (2) Eligible entities: to qualify for a grant, cooperative agreement, or contract, an entity must (A) be a state, an Indian tribe or tribal organization, a local government, a scientific or academic institution, or a nonprofit organization, and (B) submit an application to the Secretary, in the time, manner, and form the Secretary requires, describing the activities it plans to carry out with the funds. (3) Additional application contents: the Secretary may require the application to also include (A) naming an individual to serve as a FASD state or tribal coordinator for the entity's proposed activities, and (B) describing an advisory committee the entity will set up to guide it in building and running a statewide or tribal strategic plan to prevent FASD and support people with FASD and their families. (c) Definition of FASD-informed. For this section, "FASD-informed" — describing a support or intervention program — means the support or program uses culturally and linguistically informed, evidence-based or practice-based interventions and appropriate resources, aimed at improving the quality of life of a person with FASD and that person's family.
