When a state adds up what it spent on its boating safety program, it must follow the Secretary's rules. The total can include costs like equipment, salaries, training, public education, and other expenses the Secretary allows. The Secretary decides any dispute about how this total is calculated.
(a) — Following the Secretary's rules, a state's total spending on its boating safety program must include: (1) the cost of acquiring, maintaining, and running land, facilities, equipment, and supplies; (2) personnel salaries and reimbursable expenses; (3) the cost of training personnel; (4) public boat safety education; (5) the cost of carrying out the program generally; and (6) any other expenses the Secretary decides fit.
(b) — The Secretary decides any question that comes up about how this total is calculated under subsection (a).
Consistent with regulations prescribed by the Secretary, the computation by a State* of amounts expended for the State recreational boating safety program* shall include—
the acquisition, maintenance, and operating costs of land, facilities, equipment, and supplies;
personnel salaries and reimbursable expenses;
the costs of training personnel;
public boat safety education;
the costs of carrying out the program; and
other expenses that the Secretary considers appropriate.
The Secretary shall decide an issue arising out of the computation made under subsection (a) of this section.
