This section establishes the Cable Security Fleet and sets eligibility, citizenship, inspection, and age-waiver rules.

(a) (1) The Secretary, consulting the Operating Agency, must establish an active, commercially viable fleet of cable vessels meeting national-security needs. It consists of privately owned, United States-documented cable vessels with Operating Agreements and is the Cable Security Fleet. (2) It must include two vessels. (b) A cable vessel qualifies if (1) it meets one of (c)(1)–(4); (2) it is or will be in commercial service providing cable services; (3) it is no more than 40 years old when included; (4) the Operating Agency finds it suitable for United States cable services in the national interest and the Secretary finds it commercially viable, alone or counting participation payments; and (5) it is United States-documented, or its owner intends to document it and it is eligible when the agreement is made. (c) Citizenship. (1) It qualifies if one or more section 50501 citizens will own and operate it during the agreement. (2) It qualifies if (A) a section 50501 citizen or United States citizen trust owns it and a person eligible to document it demise-charters and operates it, with a United States-citizen chairman, chief executive officer, and majority of directors appointed and removable only with Secretary approval, and certification that no law bars the Contractor from performing; (B) a noncitizen owner or controller of that charterer agrees not to influence operation against United States interests; and (C) the Secretary and Operating Agency notify the listed committees that they concur, reviewed the certification, and found no impediment. (3) It qualifies if an eligible person owns and operates it, operates or manages other United States-documented vessels for Defense or charters to Defense, has a Defense special security agreement, makes the (2)(A)(III) certification, and when relevant the (2)(B) agreement; the required officials must make the stated committee notification and finding. (4) It qualifies if an eligible person owns it and a section 50501 citizen demise-charters it. (d) Standards. A qualifying but previously undocumented cable vessel may receive a certificate of inspection if the Coast Guard department Secretary finds the classification/design, international-compliance, and prior-country enforcement conditions in paragraph (1)(A)–(C). (2) That rule stops applying after failure to comply with those agreements or guidelines. (3) The Secretary may rely on accepted-society certification; a foreign society requires reciprocal access for American Bureau of Shipping and United States offices and records. (e) The Secretary and Operating Agency may waive the age limit if they jointly find the waiver is in the national interest, the vessel and network are or will remain economically viable, and other compliant vessels and operators are unavailable.
