submitted 43 years ago by Pub. L. 98-89 to r/title-46-SHIPPING · 126 words · no verdicts yet

in plain englishAI-generated · not legal advice

This law lets the government suspend or revoke mariners' licenses and documents to keep the seas safe. A revoked license can only be replaced after the Secretary confirms good discipline and safety allow it. The former holder must also prove the reasons for revocation no longer apply.

(a) The point of suspending or revoking licenses, certificates, and documents under this chapter is to promote safety at sea. (b) A license, certificate of registry, or merchant mariner's document may be suspended or revoked for the acts described in section 7703 of this title. (c) When one of these has been revoked, the former holder may only get a new license, certificate of registry, or merchant mariner's document after two things happen: (1) the Secretary decides, under the Secretary's own regulations, that issuing a new one is compatible with the need for good discipline and safety at sea; and (2) the former holder gives satisfactory proof that the reasons for the revocation are no longer valid. (d) The Secretary may prescribe regulations to carry out this chapter.
