The Oversight Board sets the schedule for developing, submitting, approving, and certifying Fiscal Plans. A Fiscal Plan must meet detailed fiscal, service, pension, debt, governance, investment, and priority requirements, and the Board may approve a Governor’s plan or create one if necessary.
(a) In general. After all Oversight Board* members and the Chair are appointed under section 2121(e), as soon as practicable in the Board’s establishing fiscal year, and in each later fiscal year while the Board operates, the Board must give the Governor* a notice with a schedule for developing, submitting, approving, and certifying Fiscal Plans. The notice may also schedule revisions to already certified plans; those revisions must later be approved and certified by the Board. The Board must consult the Governor when creating the schedule, but keeps sole discretion to set or change its dates by a later notice if the dates are appropriate and reasonably feasible.
(b) Requirements. (1) In general. A Fiscal Plan* for a territorial government* or covered territorial instrumentality* must provide a way to achieve fiscal responsibility and access to capital markets, and must—
(A) estimate revenue and spending using agreed accounting standards*, based on (i) applicable laws or (ii) specific bills that must be enacted to reasonably achieve the plan’s projections;
(B) ensure funding for essential public services;
(C) adequately fund public pension systems;
(D) eliminate structural deficits;
(E) for covered fiscal years when a stay under subchapter III or IV is not effective, provide a sustainable debt burden;
(F) improve fiscal governance, accountability, and internal controls;
(G) make it possible to reach fiscal targets;
(H) create independent revenue forecasts for the plan’s period;
(I) include an analysis of whether debt is sustainable;
(J) provide capital spending and investment needed to promote economic growth;
(K) adopt appropriate recommendations the Board submits under section 2145(a);
(L) include additional information the Board considers necessary;
(M) ensure that a territorial instrumentality’s assets, funds, or resources are not loaned, transferred, or otherwise used for the benefit of a covered territory* or another covered territorial instrumentality* of that territory*, unless the territory’s constitution, an approved plan of adjustment under subchapter III, or a Qualifying Modification approved under subchapter VI permits it; and
(N) respect applicable lawful priorities and lawful liens in the constitution, other laws, or agreements of a covered territory or covered territorial instrumentality that were in effect before June 30, 2016.
(2) Term. The Board decides how many fiscal years a Fiscal Plan covers, but it must cover at least five fiscal years starting with the fiscal year in which the Board certifies it.
(c) Development, review, approval, and certification. (1) Timing requirement. The Governor may not submit a Territory Budget* under section 2142 for a fiscal year unless the Board has certified that year’s Territory Fiscal Plan* under this subsection. The Board may waive this requirement in its sole discretion.
(2) Plan developed by Governor. The Governor must submit each proposed Fiscal Plan the Board requires by the deadline in the subsection (a) notice.
(3) Board review. The Board must review a proposed plan to decide whether it meets subsection (b). If the Board decides in its sole discretion that the plan (A) meets those requirements, it must approve it; or (B) does not meet them, it must give the Governor (i) a violation notice with recommendations for revising the plan and (ii) an opportunity to correct the violation under subsection (d)(1).
(d) Revised Fiscal Plan. (1) In general. After receiving a violation notice under subsection (c)(3), the Governor must submit a revised proposed plan meeting subsection (b) by the deadline in the subsection (a) notice. The Governor may submit as many revised plans as that notice’s schedule allows.
(2) Board development. If the Governor does not submit, by the deadline, a plan the Board decides in its sole discretion meets subsection (b), the Board must develop and submit a compliant plan to the Governor and Legislature*.
(e) Approval and certification. (1) Governor’s plan. If the Board approves a plan under subsection (c)(3), it must give the Governor and Legislature a compliance certification for it.
(2) Board’s plan. If the Board develops a plan under subsection (d)(2), the Governor is treated as having approved it. The Board must issue a compliance certification to the Governor and Legislature.
(f) Joint development. Despite the other provisions of this section, if the Governor and Board jointly develop a Fiscal Plan that meets this section for a fiscal year, and both certify that it reflects their consensus, that plan serves as the Fiscal Plan for the territory or territorial instrumentality for that fiscal year.
As soon as practicable after all of the members and the Chair have been appointed to the Oversight Board* in accordance with section 2121(e) of this title in the fiscal year in which the Oversight Board is established, and in each fiscal year thereafter during which the Oversight Board is in operation, the Oversight Board shall deliver a notice to the Governor* providing a schedule for the process of development, submission, approval, and certification of Fiscal Plans. The notice may also set forth a schedule for revisions to any Fiscal Plan* that has already been certified, which revisions must be subject to subsequent approval and certification by the Oversight Board. The Oversight Board shall consult with the Governor in establishing a schedule, but the Oversight Board shall retain sole discretion to set or, by delivery of a subsequent notice to the Governor, change the dates of such schedule as it deems appropriate and reasonably feasible.
A Fiscal Plan developed under this section shall, with respect to the territorial government* or covered territorial instrumentality*, provide a method to achieve fiscal responsibility and access to the capital markets, and—
provide for estimates of revenues and expenditures in conformance with agreed accounting standards* and be based on—
applicable laws; or
specific bills that require enactment in order to reasonably achieve the projections of the Fiscal Plan;
ensure the funding of essential public services;
provide adequate funding for public pension systems;
provide for the elimination of structural deficits;
for fiscal years covered by a Fiscal Plan in which a stay under subchapters III or IV is not effective, provide for a debt burden that is sustainable;
improve fiscal governance, accountability, and internal controls;
enable the achievement of fiscal targets;
create independent forecasts of revenue for the period covered by the Fiscal Plan;
include a debt sustainability analysis;
provide for capital expenditures and investments necessary to promote economic growth;
adopt appropriate recommendations submitted by the Oversight Board under section 2145(a) of this title;
include such additional information as the Oversight Board deems necessary;
ensure that assets, funds, or resources of a territorial instrumentality* are not loaned to, transferred to, or otherwise used for the benefit of a covered territory* or another covered territorial instrumentality of a covered territory*, unless permitted by the constitution of the territory, an approved plan of adjustment under subchapter III, or a Qualifying Modification approved under subchater VI; and
respect the relative lawful priorities or lawful liens, as may be applicable, in the constitution, other laws, or agreements of a covered territory or covered territorial instrumentality in effect prior to June 30, 2016.
A Fiscal Plan developed under this section shall cover a period of fiscal years as determined by the Oversight Board in its sole discretion but in any case a period of not less than 5 fiscal years from the fiscal year in which it is certified by the Oversight Board.
The Governor may not submit to the Legislature* a Territory Budget* under section 2142 of this title for a fiscal year unless the Oversight Board has certified the Territory Fiscal Plan* for that fiscal year in accordance with this subsection, unless the Oversight Board in its sole discretion waives this requirement.
The Governor shall submit to the Oversight Board any proposed Fiscal Plan required by the Oversight Board by the time specified in the notice delivered under subsection (a).
The Oversight Board shall review any proposed Fiscal Plan to determine whether it satisfies the requirements set forth in subsection (b) and, if the Oversight Board determines in its sole discretion that the proposed Fiscal Plan—
satisfies such requirements, the Oversight Board shall approve the proposed Fiscal Plan; or
does not satisfy such requirements, the Oversight Board shall provide to the Governor—
a notice of violation that includes recommendations for revisions to the applicable Fiscal Plan; and
an opportunity to correct the violation in accordance with subsection (d)(1).
If the Governor receives a notice of violation under subsection (c)(3), the Governor shall submit to the Oversight Board a revised proposed Fiscal Plan in accordance with subsection (b) by the time specified in the notice delivered under subsection (a). The Governor may submit as many revised Fiscal Plans to the Oversight Board as the schedule established in the notice delivered under subsection (a) permits.
If the Governor fails to submit to the Oversight Board a Fiscal Plan that the Oversight Board determines in its sole discretion satisfies the requirements set forth in subsection (b) by the time specified in the notice delivered under subsection (a), the Oversight Board shall develop and submit to the Governor and the Legislature a Fiscal Plan that satisfies the requirements set forth in subsection (b).
If the Oversight Board approves a Fiscal Plan under subsection (c)(3), it shall deliver a compliance certification for such Fiscal Plan to the Governor and the Legislature.
If the Oversight Board develops a Fiscal Plan under subsection (d)(2), such Fiscal Plan shall be deemed approved by the Governor, and the Oversight Board shall issue a compliance certification for such Fiscal Plan to the Governor and the Legislature.
Notwithstanding any other provision of this section, if the Governor and the Oversight Board jointly develop a Fiscal Plan for the fiscal year that meets the requirements under this section, and that the Governor and the Oversight Board certify that the fiscal plan 1 reflects a consensus between the Governor and the Oversight Board, then such Fiscal Plan shall serve as the Fiscal Plan for the territory or territorial instrumentality for that fiscal year.
