49 U.S.C. § 105 — National Highway Traffic Safety Administration

(a) The National Highway Traffic Safety Administration is an agency inside the Department of Transportation. (b) The Administrator, who leads the Administration, is appointed by the President with the Senate's approval. The Administration also has a Deputy Administrator, appointed by the Secretary of Transportation with the President's approval. (c) The Administrator must carry out: (1) the Secretary's duties under chapter 4 of title 23 — except duties related to highway design, construction, maintenance, traffic control devices, spotting accident-prone locations, and pedestrian safety, which belong to the Federal Highway Administration instead; and (2) any other duties the Secretary assigns. (d) The Secretary may carry out chapter 301 of this title (motor vehicle safety) through the Administrator. (e) The Administrator must consult with the Federal Highway Administrator on everything related to designing, building, maintaining, and operating highways.
