submitted 31 years ago by Pub. L. 104-88 to r/title-49-TRANSPORTATION · 148 words · no verdicts yet
During war or threatened war, the Board must give priority to traffic the President identifies as essential to national defense and security. Rail carriers must facilitate military traffic, and their embargoes do not apply to United States Government shipments for its use.
(a)(1) During war or threatened war, if the President tells the Board that giving certain traffic preference or priority is essential to United States defense and security, the Board must direct that traffic to receive it.
(a)(2) If the President demands priority for troops and war material over all other traffic, every rail carrier under the Board’s jurisdiction must use every means it controls to facilitate and speed military traffic.
(b) An embargo imposed by such a carrier does not apply to shipments consigned to United States Government agents for Government use. The carrier must deliver those shipments as promptly as possible.
When the President, during time of war or threatened war, notifies the Board that it is essential to the defense and security of the United States to give preference or priority to the movement of certain traffic, the Board shall direct that preference or priority be given to that traffic.
When the President, during time of war or threatened war, demands that preference and precedence be given to the transportation of troops and material of war over all other traffic, all rail carriers providing transportation subject to the jurisdiction of the Board under this part shall adopt every means within their control to facilitate and expedite the military traffic.
An embargo imposed by any such rail carrier does not apply to shipments consigned to agents of the United States Government for its use. The rail carrier shall deliver those shipments as promptly as possible.
