OPM may write rules to run this chapter, including who is eligible for coverage. OPM cannot exclude employees just because their job is hazardous, or exclude certain long-serving D.C. teachers or part-time career employees. The Secretary of Agriculture writes separate rules for one specific individual named elsewhere in this chapter.

(a) The Office of Personnel Management (OPM) may write regulations needed to carry out this chapter's purposes. (b) OPM's regulations may set when, and under what conditions, an employee is eligible for coverage. After consulting the head of the relevant agency, OPM may exclude an employee based on the nature or type of their job — such as short-term, seasonal, or intermittent work. But OPM cannot exclude: (1) An employee or group of employees just because their job is hazardous; (2) A D.C. Board of Education teacher whose pay is set under section 1501 of title 31, District of Columbia Code, just because they're on a temporary appointment, if they've worked for the Board for at least two total school years; or (3) An employee working part-time on a "career employment basis" as defined in section 3401(2) of this title. (c) The Secretary of Agriculture must write regulations to apply this chapter to the individual named in section 8701(a)(8) of this title.
