54 U.S.C. § 200303 — Availability of funds

(a) In General. Money deposited in the Fund for fiscal year 2020 and every year after becomes available to spend starting in fiscal year 2021, automatically — no further appropriation or yearly deadline is needed to use it for the Fund's purposes. (b) Additional Amounts. This automatic funding comes on top of, not instead of, money already made available under the Gulf of Mexico Energy Security Act of 2006 or other Fund appropriations. (c) Allocation Authority. (1) The President must send Congress a detailed breakdown of how the full amount under subsection (a) will be spent, by account, program, and project — within 90 days of the Great American Outdoors Act becoming law for fiscal year 2021, and as part of the annual budget for every year after. (2) Congress can pass appropriations laws setting a different allocation than the President's plan. If Congress hasn't set an alternate allocation by the time the Interior Department's annual appropriations law is enacted, the President allocates the money. If Congress does set an alternate allocation but it's less than the full amount, the President allocates whatever's left over. (3) Any money spent under this section must follow the recreational-public-access rules in section 200306(c) — those cover hunting, fishing, recreational shooting, and other outdoor recreation. (4) The President must also send Congress an annual report showing the final allocation by account, program, and project, including the status of obligations and spending.
