6 U.S.C. § 105 — Biodefense analysis and budget submission

(a) Annual analysis. Starting in fiscal year 2023, for each fiscal year, the Director of the Office of Management and Budget, working with the Secretary of Health and Human Services, must: (1) do a detailed, comprehensive analysis of federal biodefense programs; and (2) build one combined biodefense budget submission. (b) Definition of biodefense. Following the National Biodefense Strategy, the Director must create and share with all federal departments and agencies one unified definition of "biodefense," so everyone knows which programs and activities belong in the annual budget submission required by subsection (a). (c) What the analysis must cover. It must include: (1) showing all money requested for biodefense — both mandatory and discretionary spending — broken down by agency and by category, such as threat awareness, prevention, deterrence, preparedness, surveillance and detection, response, attribution (including bioforensics), recovery, and mitigation; and (2) detailed explanations of how each program lines up with the goals of the National Biodefense Strategy required under section 104. (d) Sending it to Congress. The Director, working with the Secretary of Health and Human Services, must send this analysis to Congress at the same time as the President's yearly budget request.
