6 U.S.C. § 315 — Functions transferredtransferred

(a) In general. Except for what subsection (b) excludes, two things transfer to the Agency: (1) all of FEMA's functions as they existed on June 1, 2006 — including its work on emergency alert systems and on continuity-of-operations and continuity-of-government plans — plus all of its personnel, property, components, legal authority, grant programs, debts, and the duties of the Under Secretary for Federal Emergency Management; and (2) the Directorate of Preparedness as it existed on June 1, 2006, with all of its functions, personnel, property, components, legal authority, grant programs, debts, and the duties of the Under Secretary for Preparedness. (b) Exceptions. Four things inside the Preparedness Directorate do not transfer: (1) the Office of Infrastructure Protection; (2) the National Communications System; (3) the National Cybersecurity Division; and (4) the functions, personnel, property, components, legal authority, and debts belonging to those three offices.
