If the trustee position becomes vacant during a case, pending lawsuits do not stop. A new trustee simply takes over as the party.
If the office of trustee becomes vacant while a bankruptcy case is going on, this does not stop or end any pending lawsuit or proceeding. The new trustee who replaces the old one takes the old trustee's place as a party in that lawsuit or proceeding.
A vacancy in the office of trustee during a case does not abate any pending action or proceeding, and the successor trustee shall be substituted as a party in such action or proceeding.
