This section lets the Secretary insure certain mortgages connected with government, public, veteran, special-purpose, and other housing projects. It also sets special rules for refinancing, operating-loss loans, older urban areas, multifamily housing, hospitals, and related properties.

(a) Projects covered. After a mortgagee applies, the Secretary may insure, or promise to insure, under any applicable part of this chapter a mortgage connected with: (1) the Government’s sale of housing acquired or built under the listed amended public laws, including related property; (2) the Secretary of Housing and Urban Development’s, or an approved public housing agency’s, sale of housing owned or financially assisted under Public Law 671, including related property; (3) the Government’s sale of the Greenbelt towns and listed projects, Tennessee Valley Authority village or employee housing, and Interior Department housing in the Coulee Dam town area; for sales by the Secretary of the Interior under subsections 3(b)(1) and 3(b)(2) of the Coulee Dam Community Act of 1957, the selling price is treated as the appraised value; permanent housing under the jurisdiction of the Department of the Interior, constructed under the Boulder Canyon Project Act and located within the Boulder City municipal area, is also a separate covered category; and for sales by the Secretary of the Interior under subsections 3(b)(1) and 3(b)(2) of the Boulder City Act of 1958, the selling price is treated as the appraised value; (4) the Government’s sale of housing under the Atomic Energy Community Act, without preferences or priorities except those in this chapter or that Act; (5) a State, municipality, or its agency’s sale of permanent housing built for World War II veterans, Korean veterans, their families, and others; (6) the first resale, within two years after Government acquisition, of property described in (1) through (4); (7) refinancing an existing insured mortgage, or a Secretary-held mortgage subject to a mortgage restructuring and rental assistance sufficiency plan under the Multifamily Assisted Housing Reform and Affordability Act of 1997. Under (7)(A), the refinancing principal cannot exceed the original principal or the remaining term, and its interest rate is agreed by the borrower and lender. The refinancing principal may equal the outstanding balance of a mortgage insured under section 1715z–10 if the new monthly payment is lower. The lender cannot require a minimum outstanding balance. If the Secretary finds an added insurance term benefits the insurance fund, the new term may be up to 12 years longer than the remaining term. A multifamily refinancing must amend the existing insurance contract, not use a new one. Under (7)(B), mortgages described in (1) through (6) must stay within the applicable maturity and principal limits; a mortgage under (5) cannot exceed 90 percent of appraised value, and its interest rate is agreed by borrower and lender. Under (7)(C), a mortgage covered by the 1997 Act’s plan may have a term of up to 30 years. (8) a Government sale of housing acquired under section 3374 of title 42. (b) Urban-renewal refinancing. Despite this subchapter’s usual rules, the Secretary may insure under section 1715l(d)(3) a mortgage refinancing an existing mortgage on a property or project, other than a one-to-four-family structure, in an urban renewal area if the Secretary finds that insurance will help house low- or moderate-income families or people displaced from an urban renewal area or by government action. (c) Assigned mortgages. The Secretary may insure a mortgage assigned to the Secretary after an insurance payment, or a mortgage connected with the Secretary’s sale, including a sale through an authorized other entity, of property acquired under this chapter. The usual eligibility, premium, insurance-settlement, and insurance-benefit limits do not apply. (d) Operating-loss loans. (1) The Secretary may, at the Secretary’s discretion and on prescribed terms, insure loans covering operating losses of projects with existing Secretary-insured project mortgages. “Operating loss” means the project’s taxes, mortgage interest, mortgage-insurance premiums, hazard-insurance premiums, and maintenance and operating expenses, together, exceed project income. (2) A loan qualifies if (A) the existing mortgage was insured before or after February 5, 1988, and covers property without a one-to-four-family dwelling; (B) the loss occurred during the first 24 months after project completion, as determined by the Secretary; and (C) the loan does not exceed the loss. (3) A loan also qualifies if (A) the mortgage was insured before or after February 5, 1988, covers property without a one-to-four-family dwelling, and does not cover a subsidized project as defined by the Secretary; (B) the loan does not exceed 80 percent of the owner’s unreimbursed cash contributions made on or after March 18, 1987, during a consecutive period of no more than 24 months in the first 10 years after completion, and never exceeds the operating loss for that period; (C) it is made within 10 years after that period ends; and (D) the project meets the Secretary’s underwriting and other requirements. (4) Each loan must have an agreed interest rate, security required by the Secretary, a term no longer than the original mortgage’s remaining term, and insurance under the same section as the original mortgage. The Secretary may insure under (2), (3), or both, but not both for the same months. The premium is calculated at the original mortgage’s rate and is payable in cash or insurance-fund debentures at face value plus accrued interest. If the borrower misses a payment on the loan or original mortgage, both are in default; after 30 days of continuing default, the lender receives benefits calculated like the original mortgage, using the loan’s commitment and insurance dates for the loan-related debentures. (5) A loan involving a section 1715e project is the obligation of the Cooperative Management Housing Insurance Fund. A loan involving a section 1715z–1 project, or a project insured under this subchapter through subsection (e), is the obligation of the Special Risk Insurance Fund. (6) The Secretary may not reduce an operating-loss loan solely because money was escrowed for initial operating deficits. If such a loan was insured before October 28, 1992, and was reduced solely for that reason, the Secretary must insure an increase or separate loan, subject to available appropriations, equal to the lesser of the subsection’s maximum and current underwriting limits or the escrow amount. (e) Older, declining urban areas. Despite this chapter except section 1715c, and despite eligibility limits except section 1709(g), the Secretary may insure a mortgage for repair, rehabilitation, construction, or purchase in an older, declining urban area where ordinary eligibility requirements cannot be met, if the Secretary finds that the area is reasonably viable, considering the need for adequate low- and moderate-income housing or group-practice facilities, and that the property is an acceptable risk. The Special Risk Insurance Fund bears this insurance. (f) Existing multifamily projects, hospitals, and rehabilitated rental property. (1) The Secretary may, at the Secretary’s discretion, insure a mortgage for buying or refinancing an existing multifamily project, or for buying or refinancing the existing debt of an existing hospital, nursing home, assisted-living facility, intermediate-care facility, board-and-care home, or combination of these. (2) For a multifamily project in an older, declining urban area, the Secretary must make available up to $30 million of purchase authority under section 1720 to lower interest rates for low- and moderate-income rental housing in projects with 100 or fewer units that otherwise could not be refinanced and moderately rehabilitated without excessive rent burdens. The Secretary must require that refinancing lower monthly debt service only as needed for continued economic viability, considering rent reductions, and that rent increases during the mortgage term occur only to cover actual reasonable operating or other necessary expense increases and maintain Secretary-approved reasonable profits. (3) For insurance based on a commitment after October 8, 1980, the Secretary may not accept prepayment or request refinancing of a rental-housing mortgage unless the borrower and successors are obligated to keep the property rental housing for five years after insurance (20 years for a mortgage purchased under section 1720), unless the Secretary finds that a genuine tenants’ organization representing a majority supports conversion to cooperative or condominium ownership, rental housing is clearly unnecessary for adequate low- and moderate-income rental opportunities, or continued rental use would harm the neighborhood. (4) For hospital or listed facility refinancing, the Secretary must require that refinancing lower monthly debt service, considering refinancing fees; proceeds pay only existing debt and necessary refinancing costs; the facility is economically viable; and the applicable certificates, studies, and statements required by section 1715w or section 1715z–7 have been satisfied. (5) For purchase or refinancing involving property rehabilitated or developed under section 1437o of title 42, the Secretary may include rehabilitation or development costs up to $20,000 per unit, increase that by up to 25 percent where costs require it, permit subordinated liens for the full amount of State or local government mortgage financing, and pay benefits in cash unless the mortgagee requests debentures in writing. (g) Non-self-contained units. The Secretary may insure, at the Secretary’s discretion, a mortgage covering a multifamily project that includes units that are not self-contained.

(A)

the principal amount of any such refinancing mortgage shall not exceed the original principal amount or the unexpired term of such existing mortgage and shall bear interest at such rate as may be agreed upon by the mortgagor and the mortgagee, except that (i) the principal amount of any such refinancing mortgage may equal the outstanding balance of an existing mortgage insured pursuant to section 1715z–10 1 of this title, if the amount of the monthly payment due under the refinancing mortgage is less than that due under the existing mortgage for the month in which the refinancing mortgage is executed; (ii) a mortgagee may not require a minimum principal amount to be outstanding on the loan secured by the existing mortgage; (iii) in any case involving the refinancing of a loan in which the Secretary determines that the insurance of a mortgage for an additional term will inure to the benefit of the applicable insurance fund, taking into consideration the outstanding insurance liability under the existing insured mortgage, such refinancing mortgage may have a term not more than twelve years in excess of the unexpired term of such existing insured mortgage; and (iv) any multifamily mortgage that is refinanced under this paragraph shall be documented through amendments to the existing insurance contract and shall not be structured through the provisions of a new insurance contract; and

(B)

a mortgage of the character described in paragraphs (1) through (6) of this subsection shall have a maturity and a principal obligation not in excess of the maximums prescribed under the applicable section or subchapter of this chapter, except that in no case may the principal obligation of a mortgage referred to in paragraph (5) of this subsection exceed 90 per centum of the appraised value of the mortgaged property, and shall bear interest at such rate as may be agreed upon by the mortgagor and the mortgagee;

(C)

a mortgage that is subject to a mortgage restructuring and rental assistance sufficiency plan pursuant to the Multifamily Assisted Housing Reform and Affordability Act of 1997 (42 U.S.C. 1437f note) and is refinanced under this paragraph may have a term of not more than 30 years; or

(8)

executed in connection with the sale by the Government of any housing acquired pursuant to section 3374 of title 42.

(b) Insurance of mortgages given to refinance mortgages covering existing property or projects in urban renewal areas

Notwithstanding any of the provisions of this subchapter and without regard to limitations upon eligibility contained in section 1715l of this title, the Secretary may in his discretion insure under section 1715l(d)(3) of this title any mortgage executed by a mortgagor of the character described therein where such mortgage is given to refinance a mortgage covering an existing property or project (other than a one- to four-family structure) located in an urban renewal area, if the Secretary finds that such insurance will facilitate the occupancy of dwelling units in the property or project by families of low or moderate income or families displaced from an urban renewal area or displaced as a result of governmental action.

(c) Insurance of certain assigned mortgages

The Secretary shall also have authority to insure under this chapter any mortgage assigned to the Secretary in connection with payment under a contract of mortgage insurance or executed in connection with the sale by the Secretary, including a sale through another entity acting under authority of the fourth sentence of section 1710(g) of this title, of any property acquired under any section or subchapter of this chapter without regard to any limitations or requirements contained in this chapter upon the eligibility of the mortgage, upon the payment of insurance premiums, or upon the terms and conditions of insurance settlement and the benefits of the insurance to be included in such settlement.

(d) Insurance of loans made to cover operating losses of certain projects having existing mortgages insured by Secretary
(1)

Notwithstanding any other provision of this chapter, the Secretary is authorized to insure loans made to cover the operating losses of certain projects that have existing project mortgages insured by the Secretary. Insurance under this subsection shall be in the Secretary’s discretion and upon such terms and conditions as the Secretary may prescribe, and shall be provided in accordance with the provisions of this subsection. For purposes of this subsection, the term “operating loss” means the amount by which the sum of the taxes, interest on the mortgage debt, mortgage insurance premiums, hazard insurance premiums, and the expense of maintenance and operation of the project covered by the mortgage, exceeds the income of the project.

(2)

To be eligible for insurance pursuant to this paragraph—

(A)

the existing project mortgage (i) shall have been insured by the Secretary at any time before or after February 5, 1988; and (ii) shall cover any property, other than a property upon which there is located a 1- to 4-family dwelling;

(B)

the operating loss shall have occurred during the first 24 months after the date of completion of the project, as determined by the Secretary; and

(C)

the loan shall be in an amount not exceeding the operating loss.

(3)

To be eligible for insurance pursuant to this paragraph—

(A)

the existing project mortgage (i) shall have been insured by the Secretary at any time before or after February 5, 1988; (ii) shall cover any property, other than a property upon which there is located a 1- to 4-family dwelling; and (iii) shall not cover a subsidized project, as defined by the Secretary;

(B)

the loan shall be in an amount not exceeding 80 percent of the unreimbursed cash contributions made on or after March 18, 1987, by the project owner for the use of the project, during any period of consecutive months (not exceeding 24 months) in the first 10 years after the date of completion of the project, as determined by the Secretary, except that in no event may the amount of the loan exceed the operating loss during such period;

(C)

the loan shall be made within 10 years after the end of the period of consecutive months referred to in the preceding subparagraph; and

(D)

the project shall meet all applicable underwriting and other requirements of the Secretary at the time the loan is to be made.

(4)

Any loan insured pursuant to this subsection shall (A) bear interest at such rate as may be agreed upon by the mortgagor and mortgagee; (B) be secured in such manner as the Secretary shall require; (C) be limited to a term not exceeding the unexpired term of the original mortgage; and (D) be insured under the same section as the original mortgage. The Secretary may provide insurance pursuant to paragraph (2) or (3), or pursuant to both such paragraphs, in connection with an existing project mortgage, except that the Secretary may not provide insurance pursuant to both such paragraphs in connection with the same period of months referred to in paragraphs (2)(B) and (3)(B). The Secretary is authorized to collect a premium charge for insurance of loans pursuant to this subsection in an amount computed at the same premium rate as is applicable to the original mortgage. This premium shall be payable in cash or in debentures of the insurance fund under which the loan is insured at par plus accrued interest. In the event of a failure of the borrower to make any payment due under such loan or under the original mortgage, both the loan and original mortgage shall be considered in default, and if such default continues for a period of thirty days, the lender shall be entitled to insurance benefits, computed in the same manner as for the original mortgage, except that in determining the interest rate under section 1715o of this title for the debentures representing the portion of the claim applicable to the loan, the date of the commitment to insure the loan and the insurance date of the loan shall be taken into consideration rather than the commitment or insurance date for the original mortgage.

(5)

A loan involving a project covered by a mortgage insured under section 1715e of this title that is the obligation of the Cooperative Management Housing Insurance Fund shall be the obligation of such fund, and loans involving projects covered by a mortgage insured under section 1715z–1 of this title or under any section of this subchapter pursuant to subsection (e) of this section shall be the obligation of the Special Risk Insurance Fund.

(6)

In determining the amount of an operating loss loan to be insured pursuant to this subsection, the Secretary shall not reduce such amount solely to reflect any amounts placed in escrow (at the time the existing project mortgage was insured) for initial operating deficits. If an operating loss loan was insured by the Secretary pursuant to this subsection before October 28, 1992, and was reduced solely to reflect the amount placed in escrow for initial operating deficits, the Secretary shall insure, to the extent of the availability of insurance authority provided in appropriation Acts, an increase in the existing loan or a separate loan, in an amount equal to the lesser of (A) the maximum amount permitted under this subsection and the applicable underwriting requirements established by the Secretary and in effect at the time the loan is to be made, or (B) the amount of the escrow for initial operating deficits.

(e) Insurance of mortgages executed in connection with repair, rehabilitation, construction, or purchase of property in older, declining urban areas

Notwithstanding any of the provisions of this chapter except section 1715c of this title, and without regard to limitations upon eligibility contained in any section of this subchapter or subchapter IX–B, other than the limitation in section 1709(g) of this title, the Secretary is authorized, upon application by the mortgagee, to insure under any section of this subchapter or subchapter IX–B a mortgage executed in connection with the repair, rehabilitation, construction, or purchase of property located in an older, declining urban area in which the conditions are such that one or more of the eligibility requirements applicable to the section or subchapter under which insurance is sought could not be met, if the Secretary finds that (1) the area is reasonably viable, giving consideration to the need for providing adequate housing or group practice facilities for families of low and moderate income in such area, and (2) the property is an acceptable risk in view of such consideration. The insurance of a mortgage pursuant to this subsection shall be the obligation of the Special Risk Insurance Fund.

(f) Insurance of mortgages executed in connection with purchase or refinancing of existing multifamily housing project; refinancing of existing debt of existing hospital, or purchase or refinancing of rental rehabilitated property; terms and conditions, etc.
(1)

Notwithstanding any of the provisions of this chapter, the Secretary is authorized, in his discretion, to insure under any section of this subchapter a mortgage executed in connection with the purchase of 2 refinancing of an existing multifamily housing project or the purchase or refinancing of existing debt of an existing hospital (or existing nursing home, existing assisted living facility, existing intermediate care facility, existing board and care home, or any combination thereof).

(2)

In the case of the purchase or refinancing under this subsection of a multifamily housing project located in an older, declining urban area, the Secretary shall make available an amount not to exceed $30,000,000 of available purchase authority pursuant to section 1720 1 of this title to reduce interest rates on low- and moderate-income rental housing in projects having 100 units or less which otherwise could not support refinancing and moderate rehabilitation without causing excessive rent burdens on current tenants due to rent increases. The Secretary shall prescribe such terms and conditions as he deems necessary to assure that—

(A)

the refinancing is used to lower the monthly debt service only to the extent necessary to assure the continued economic viability of the project, taking into account any rent reductions to be implemented by the mortgagor; and

(B)

during the mortgage term no rental increases shall be made except those which are necessary to offset actual and reasonable operating expense increases or other necessary expense increases and maintain reasonable profit levels approved by the Secretary.

(3)

For all insurance authorized by this subsection and provided pursuant to a commitment entered into after October 8, 1980, the Secretary may not accept an offer to prepay or request refinancing of a mortgage secured by rental housing unless the Secretary takes appropriate action that will obligate the borrower (and successors in interest thereof) to utilize the property as a rental property for a period of five years from the date on which the insurance was provided (twenty years in the case of any such mortgage purchased under section 1720 1 of this title) unless the Secretary finds that—

(A)

the conversion of the property to a cooperative, or condominium form of ownership is sponsored by a bona fide tenants’ organization representing a majority of the households in the project;

(B)

continuance of the property as rental housing is clearly unnecessary to assure adequate rental housing opportunities for low- and moderate-income people in the community; or

(C)

continuance of the property as rental housing would have an undesirable and deleterious effect on the surrounding neighborhood.

(4)

In the case of refinancing of an existing hospital (or existing nursing home, existing assisted living facility, existing intermediate care facility, existing board and care home, or any combination thereof) the Secretary shall prescribe such terms and conditions as the Secretary deems necessary to assure that—

(A)

the refinancing is employed to lower the monthly debt service costs (taking into account any fees or charges connected with such refinancing) of such existing hospital (or existing nursing home, existing assisted living facility, existing intermediate care facility, existing board and care home, or any combination thereof);

(B)

the proceeds of any refinancing will be employed only to retire the existing indebtedness and pay the necessary cost of refinancing on such existing hospital (or existing nursing home, existing assisted living facility, existing intermediate care facility, existing board and care home, or any combination thereof);

(C)

such existing hospital (or existing nursing home, existing assisted living facility, existing intermediate care facility, existing board and care home, or any combination thereof) is economically viable; and

(D)

the applicable requirements for certificates, studies, and statements of section 1715w of this title (for the existing nursing home, existing assisted living facility, intermediate care facility, board and care home, or any combination thereof, proposed to be refinanced) or of section 1715z–7 of this title (for the existing hospital proposed to be refinanced) have been met.

(5)

In the case of any purchase or refinancing under this subsection involving property to be rehabilitated or developed under section 1437o1 of title 42, the Secretary may—

(A)

include rehabilitation or development costs of not to exceed $20,000 per unit, except that the Secretary may increase such amount by not to exceed 25 per centum for specific properties where cost levels so require;

(B)

permit subordinated liens securing up to the full amount of mortgage financing provided by State or local governments or agencies thereof; and

(C)

pay such benefits in cash unless the mortgagee submits a written request for debenture payment.

(g) Insurance of mortgages covering multifamily housing projects including units not self-contained

Notwithstanding any other provisions of this chapter, the Secretary may, in his discretion, insure a mortgage covering a multifamily housing project including units which are not self-contained.
