12 U.S.C. § 4501 — Congressional findings

submitted 34 years ago by Pub. L. 102-550 to r/title-12-BANKS-AND-BANKING · 341 words · no verdicts yet

Congress finds that the housing enterprises and Federal Home Loan Banks have public missions and need effective, independent financial regulation. It also states that they are not backed by the United States' full faith and credit and that affordable housing must be supported while financial strength is maintained.

Congress finds that: (1) the Federal National Mortgage Association and Federal Home Loan Mortgage Corporation (together, the “enterprises”) and the Federal Home Loan Banks (the “Banks”) have important public missions in their statutes and charters; (2) because the enterprises' ability to carry out those missions matters to United States housing and the national economy, stronger Federal regulation is needed to reduce failure risk; (3) given their current operations, the enterprises and Banks pose low current financial insolvency risk; (4) neither the enterprises nor Banks, and no securities or obligations they issue, are backed by the United States' full faith and credit; (5) the regulator of the enterprises should be sufficiently independent of them and special-interest groups; (6) that regulator should be able to set capital standards, require financial disclosures, set standards for records and internal controls, examine the enterprises when needed, and enforce its standards and rules; (7) the enterprises have an affirmative duty to help finance affordable housing for low- and moderate-income families consistently with their public purposes while keeping strong finances and a reasonable economic return; and (8) the Federal Home Loan Bank Act should be amended to emphasize that the Federal Housing Finance Board's primary mission is the Banks' financial safety and soundness.
