This section requires the Export-Import Bank to create a tied-aid-credit program for United States exports, in cooperation with the Trade and Development Agency and suitable private institutions. It describes permitted combined financing methods, the program’s purpose, a possible fund, and how concessional financing or grants are made available.
(a) Program and its elements. (1) The Chairman of the Export-Import Bank* of the United States must establish a tied-aid-credit* program for United States exports within the Bank. (2) The program must be carried out with the Trade and Development Agency and, when appropriate, private financial institutions or entities. (3) The program may include— (A) combining the Bank’s credits, loans, or guarantees with concessional financing or grants made available under section 635r(d). This may include blending the Bank’s and the Trade and Development Agency’s financing or having them provide parallel financing*; and (B) combining the Bank’s credits, loans, or guarantees with financing offered by private financial institutions or entities. This may include blending the Bank’s and the private institutions’ or entities’ financing or having them provide parallel financing. (b) Purpose. The program’s purpose is to offer or arrange financing for exporting United States goods and services. The financing must be substantially as concessional as foreign financing when there is reasonable proof that the foreign financing is being offered to, or arranged for, a genuine foreign competitor for a United States export sale. (c) Fund. The Bank’s Chairman may establish a fund when necessary to carry out this tied-aid-credit program. (d) Concessional financing or grants. Concessional financing or grants made available under section 635r(d) for the mixed-financing program under this section must be made available under section 635r(c).
The Chairman of the Export-Import Bank* of the United States shall establish, within the Export-Import Bank of the United States, a program of tied aid credits for United States exports.
The program shall be carried out in cooperation with the Trade and Development Agency and with private financial institutions or entities, as appropriate.
The program may include—
the combined use of the credits, loans, or guarantees offered by the Export-Import Bank of the United States with concessional financing or grants made available under section 635r(d) of this title, by methods including the blending of the financing of, or parallel financing* by, the Bank and the Trade and Development Agency; and
the combined use of credits, loans, or guarantees offered by the Bank, with financing offered by private financial institutions or entities, by methods including the blending of the financing of, or parallel financing by, the Bank and private institutions or entities.
The purpose of the tied aid credit* program under this section is to offer or arrange for financing for the export of United States goods and services which is substantially as concessional as foreign financing for which there is reasonable proof that such foreign financing is being offered to, or arranged for, a bona fide foreign competitor for a United States export sale.
The Chairman of the Bank is authorized to establish a fund, as necessary, for carrying out the tied aid credit* program described in this section.
Concessional financing or grants made available under section 635r(d) of this title for the purposes of the mixed financing program established under this section shall be made available in accordance with the provisions of section 635r(c) of this title.
