14 U.S.C. § 2165 — Relief of retired officer promoted while on active duty

This section protects the retired grade of a regular officer who was recalled to active duty and promoted while serving. The officer receives the stated treatment when released from active duty.
Any regular officer on the retired list recalled to active duty who during such active duty is advanced to a higher grade under an appointment must, upon relief from active duty, if his performance of duty under such appointment has been satisfactory, be advanced on the retired list to the highest grade held while on such active duty.
