14 U.S.C. § 311 — United States Coast Guard Band; composition; director
submitted 61 years ago by Pub. L. 89-189 to r/title-14-COAST-GUARD · 230 words · no verdicts yet
This law sets up the U.S. Coast Guard Band and lets the Secretary pick its director and staff. The Secretary can nominate a director for a Senate-confirmed commission, capped at the rank of captain, promoted separately from other officers. If the Secretary revokes someone's director role, that person can leave the Coast Guard or return to their old rank.
(a) The Coast Guard Band is made up of a director and other staff, in whatever numbers and ranks the Secretary* decides are needed.
(b) The Secretary can pick anyone qualified to be the director. Once picked, the President can nominate that person for a commissioned rank in the Regular Coast Guard, with Senate confirmation.
(c) When someone is first commissioned as director, the Secretary sets their starting rank based on their qualifications and experience.
(d) A director commissioned this way isn't on the normal active-duty promotion list. They get promoted under section 2126 instead. But the director's rank can never go higher than captain.
(e) The Secretary can revoke someone's appointment as director at any time. If that happens, their commission under this section ends too, and they can choose to either leave the Coast Guard or go back to the rank and status they had before becoming director.
The United States Coast Guard Band shall be composed of a director and other personnel in such numbers and grades as the Secretary* determines to be necessary.
The Secretary may designate as the director any individual determined by the Secretary to possess the necessary qualifications. Upon the recommendation of the Secretary, an individual so designated may be appointed by the President, by and with the advice and consent of the Senate, to a commissioned grade in the Regular Coast Guard.
The initial appointment to a commissioned grade of an individual designated as director of the Coast Guard Band shall be in the grade determined by the Secretary to be most appropriate to the qualifications and experience of the appointed individual.
An individual who is designated and commissioned under this section shall not be included on the active duty promotion list. He shall be promoted under section 2126 of this title. However, the grade of the director may not be higher than captain.
The Secretary may revoke any designation as director of the Coast Guard Band. When an individual’s designation is revoked, his appointment to commissioned grade under this section terminates and he is entitled, at his option—
to be discharged from the Coast Guard; or
to revert to the grade and status he held at the time of his designation as director.
