15 U.S.C. § 1056 — Disclaimer of unregistrable matter

The Director may require an applicant to disclaim an unregistrable part of an otherwise registrable mark, and an applicant may disclaim one voluntarily. A disclaimer does not take away existing or later rights in the disclaimed matter.
(a) Required and voluntary disclaimers
The Director may require an applicant to disclaim an unregistrable part of an otherwise registrable mark. An applicant may voluntarily disclaim a part of a mark sought to be registered.
(b) Effect on rights
A disclaimer, including one under section 1057(e), does not harm or change the applicant’s or registrant’s existing or later rights in the disclaimed matter. It also does not harm the right to register the matter in another application if it is or becomes distinctive of the applicant’s or registrant’s goods or services.
The Director may require the applicant to disclaim an unregistrable component of a mark otherwise registrable. An applicant may voluntarily disclaim a component of a mark sought to be registered.
No disclaimer, including those made under subsection (e) of section 1057 of this title, shall prejudice or affect the applicant’s or registrant’s rights then existing or thereafter arising in the disclaimed matter, or his right of registration on another application if the disclaimed matter be or shall have become distinctive of his goods or services.
