The section establishes the Department of Commerce Nonrecurring Expenses Fund and permits certain expired discretionary balances to be transferred into it. Fund money remains available for approved technology modernization and infrastructure improvements, with advance notice to congressional appropriations committees.

(a) The Treasury must establish the Department of Commerce Nonrecurring Expenses Fund. Unobligated balances of expired discretionary funds appropriated from the Treasury’s General Fund to Commerce may be transferred into it by the end of the fifth fiscal year after the last fiscal year for which the funds were available for their original purposes. Fund amounts remain available until spent and, along with other available funds, may pay for information and business-technology modernization and necessary facilities-infrastructure improvements for Commerce, subject to OMB approval. The amounts may be obligated only after the House and Senate Appropriations Committees receive at least 15 days’ advance notice of the planned use. (b) In addition to other money provided by the Act, $20,000,000 is appropriated to the Fund, available until September 30, 2022, for necessary expenses of modernizing a business-application system.
