Money won in a state's antitrust lawsuit under section 15c must either be handed out to affected people however the court decides, or treated as a civil penalty and kept by the state. Either way, the state must give every affected person a fair chance to claim their share.

This section is a single, undivided provision. Money recovered as monetary relief in a lawsuit under section 15c(a)(1) must be handled one of two ways: (1) it can be distributed however the district court, using its own discretion, decides to authorize; or (2) the court can instead treat it as a civil penalty and let the state keep it as general revenue. Either way, whatever distribution plan is used must give each affected person a fair chance to get their proper share of the net money recovered.
