(a) In general The Secretary of Health and Human Services, in consultation with the Administrator and acting through the Assistant Secretary for Health, can conduct, and make grants to public and nonprofit private entities and enter into contracts with public and private entities for, projects for the development and evaluation of inexpensive and efficient methods (1) for determining and evaluating the health and environmental effects of chemical substances and mixtures, and their toxicity, persistence, and other characteristics which affect health and the environment, and (2) which can be used for the development of information to meet the requirements of rules, orders, or consent agreements under section 2603 of this title . The Administrator must consider such methods in prescribing under section 2603 of this title protocols and methodologies for the development of information. (b) Approval by Secretary No grant can be made or contract entered into under subsection (a) unless an application therefor has been submitted to and approved by the Secretary. Such an application is submitted in such form and manner and contain such information as the Secretary can require. The Secretary can apply such conditions to grants and contracts under subsection (a) as the Secretary determines are necessary to carry out the purposes of such subsection. Contracts can be entered into under such subsection without regard to section 3324(a) and (b) of title 31 and section 6101 of title 41 .
