15 U.S.C. § 432Boards of trade dealing in agricultural products; exclusion of representatives of cooperative associations prohibited

submitted 99 years ago by ch. 508 to r/title-15-COMMERCE-AND-TRADE · 159 words · no verdicts yet

in plain englishAI-generated · not legal advice

A board of trade for agricultural products cannot bar a lawful farm cooperative's representative from joining. The cooperative must have adequate finances and agree to follow the board's usual rules. But no board rule can stop the cooperative from returning excess money to its members.

This section protects farm cooperatives' access to boards of trade. If a board of trade's members buy or sell agricultural products, or receive them for sale on consignment, in interstate commerce, that board cannot exclude a duly authorized representative of a lawfully formed and run cooperative association from membership and its privileges. This protection covers a cooperative made up mostly of agricultural producers, whether incorporated or not, and it also covers a representative of an organization that acts for a group of such cooperatives. The cooperative or organization must have adequate financial responsibility, and it must follow, or agree to follow, the same terms and conditions imposed on the board's other members. Even so, no rule of a board of trade may be read to stop a cooperative association or organization from returning, to its genuine members, money collected on a patronage basis that is more than what it cost to run the association's business.
