15 U.S.C. § 45d — Unfair or deceptive acts or practices with respect to substance use disorder treatment service and products

(a) Unlawful activity: It is against the law to use an unfair or deceptive practice when offering any substance use disorder treatment service or product. (b) Enforcement by the FTC: (1) Unfair or deceptive acts: Breaking this law counts as breaking an FTC rule about unfair or deceptive practices, under section 18 of the FTC Act. (2) Powers of the FTC: The FTC enforces this law using all the same powers, procedures, and authority it has under the FTC Act, as if that whole Act were written into this law. Anyone who breaks this law faces the same penalties, and gets the same rights and protections, as under the FTC Act. (c) Authority preserved: Nothing here limits any other power the FTC or the FDA has under any other law.
