15 U.S.C. § 4909 — Exclusion of information

The Data Bank must exclude information that another law bars or permits withholding, and information properly classified for national defense or foreign policy under a statute or Executive order.
The Data Bank* must not include information:
(1) whose public disclosure is prohibited by another law or is otherwise authorized to be withheld under another law; or
(2) that a statute or Executive order specifically authorizes not to be disclosed in the interest of national defense or foreign policy and that is actually properly classified under that Executive order.
The Data Bank* shall not include any information—
the disclosure of which to the public is prohibited under any other provision of law or otherwise authorized to be withheld under other provision of law; or
that is specifically authorized under criteria established by statute or an Executive order not to be disclosed in the interest of national defense or foreign policy and are in fact properly classified pursuant to such Executive order.
