The Federal Trade Commission Act's ban on 'unfair methods of competition' also covers unfair competition against other exporters — even if the unfair acts happen outside U.S. territory.
This section extends the reach of the Federal Trade Commission Act's ban on unfair competition. The prohibition against 'unfair methods of competition,' and the remedies the FTC Act provides for enforcing that prohibition, are construed as extending to unfair methods of competition used in export trade against competitors who are also engaged in export trade.
This extension applies even though the acts making up the unfair methods happen outside the territorial jurisdiction of the United States.
The prohibition against “unfair methods of competition” and the remedies provided for enforcing said prohibition contained in the Federal Trade Commission Act [15 U.S.C. 41 et seq.] shall be construed as extending to unfair methods of competition used in export trade against competitors engaged in export trade, even though the acts constituting such unfair methods are done without the territorial jurisdiction of the United States.
