This section requires the Secretary to issue regulations and directs Federal agencies to cooperate in carrying out the subchapter. It authorizes agreements and requires annual review of marine-mammal programs on government lands, with possible conservation measures for declining strategic stocks.

(a) Consultation with Federal agencies. The Secretary must, after consulting any affected Federal agency, issue regulations necessary and appropriate to carry out this subchapter. (b) Cooperation by Federal agencies. Each Federal agency is authorized and directed to cooperate with the Secretary in mutually agreeable ways. (c) Contracts, leases, and cooperative agreements. The Secretary may make necessary contracts, leases, cooperative agreements, or other transactions to carry out this subchapter or subchapter V, on terms the Secretary considers appropriate, with a Federal or State agency, public or private institution, or another person. (d) Annual review; suspension. The Secretary must review each year every program in which the United States participates that involves taking marine mammals on land. If a program cannot be run on land owned by, or in which, the United States has an interest consistently with the purposes and policies of this chapter, the Secretary must suspend it and include the reasons in the annual public and congressional report required by section 1373(f), along with recommended legislation to solve the problem. (e) Measures for strategic stocks. If a stock assessment under section 1386 or other important new information shows that effects on rookeries, mating grounds, or similarly ecologically important areas may be causing a strategic stock to decline or preventing its recovery, the Secretary may develop and carry out conservation or management measures to reduce those effects. The Secretary must consult the Marine Mammal Commission and appropriate Federal agencies and provide notice and an opportunity for public comment before developing and carrying out the measures.
