The Commission must establish a nine-scientist Committee of Scientific Advisors on Marine Mammals. The section sets compensation, travel reimbursement, required consultation, and reporting of recommendations the Commission rejects.
(a) Establishment and membership. Within 90 days after the Commission is established, it must establish a Committee of Scientific Advisors on Marine Mammals, called the “Committee” in this subchapter. The Committee must have nine scientists knowledgeable about marine ecology and marine mammal* affairs. The Chairman appoints them after consulting the Chairmen or heads named in the section: the Council on Environmental Quality, the Smithsonian Institution, the National Science Foundation, and the National Academy of Sciences. (b) Compensation and travel. Except for United States* Government employees, each Committee member must be paid for each day spent performing Committee duties at the daily equivalent of the GS-18 General Schedule rate under section 5332 of title 5. Each member must be reimbursed for travel expenses, including a daily allowance instead of subsistence, as section 5703 of title 5 authorizes for intermittent Government employees. (c) Consultation and rejected recommendations. The Commission must consult the Committee about all studies and recommendations it proposes or has made, research programs conducted or proposed under this chapter, and applications for scientific-research permits. If the Commission does not adopt a recommendation made by the Committee or one of its members, the Commission must send the recommendation to the appropriate Federal agency and congressional committees with a detailed explanation of why it was not accepted.
The Commission shall establish, within ninety days after its establishment, a Committee of Scientific Advisors on Marine Mammals (hereafter referred to in this subchapter as the “Committee”). Such Committee shall consist of nine scientists knowledgeable in marine ecology and marine mammal* affairs appointed by the Chairman after consultation with the Chairman of the Council on Environmental Quality, the Secretary* of the Smithsonian Institution, the Director of the National Science Foundation, and the Chairman of the National Academy of Sciences.
Except for United States* Government employees, members of the Committee shall each be compensated at a rate equal to the daily equivalent of the rate for GS–18 of the General Schedule under section 5332 of title 5, for each day such member is engaged in the actual performance of duties vested in the Committee. Each member shall be reimbursed for travel expenses, including per diem in lieu of subsistence, as authorized by section 5703 of title 5 for persons in Government service employed intermittently.
The Commission shall consult with the Committee on all studies and recommendations which it may propose to make or has made, on research programs conducted or proposed to be conducted under the authority of this chapter, and on all applications for permits for scientific research. Any recommendations made by the Committee or any of its members which are not adopted by the Commission shall be transmitted by the Commission to the appropriate Federal agency and to the appropriate committees of Congress with a detailed explanation of the Commission’s reasons for not accepting such recommendations.
