16 U.S.C. § 410ccc–23 — Preparation of plan

(a) In general. Within 3 years of the Commission's first meeting, it must prepare and send a heritage area management plan to Louisiana's Governor. If the Governor approves it, it goes to the Secretary for review and approval. The Secretary must give technical help preparing and carrying out the plan, coordinated with the National Park Service's work on the historical park's general management plan. The plan must consider local government plans and present a unified heritage preservation and education plan, including at least: (1) an inventory of important properties and cultural landscapes worth preserving, managing, developing, and maintaining for their cultural, natural, or public-use value; (2) an analysis of current land uses and how they affect preservation and public-use goals; (3) an interpretive plan for the area's cultural and natural history and how to improve visitor use, developed with the National Park Service and coordinated with the historical park's visitor-use plans; (4) recommendations for coordinating local, state, and federal action to further this subchapter's purposes; and (5) an implementation program, including actions expected from state and local governments and other groups. (b) Approval of plan. The Secretary must approve or reject the plan within 90 days of receiving it. The Commission must tell the Secretary whether Louisiana's Governor has approved the plan when it's submitted. In deciding whether to approve it, the Secretary considers: (1) whether the Commission gave the public and government adequate chances — including meetings and hearings — to be involved in preparing the plan; and (2) whether state and local governments have given reasonable assurance that they support the plan and that carrying it out is feasible. (c) Disapproval of plan. If the Secretary rejects the plan, the Secretary must tell the Commission in writing why, and give recommendations and help revising it. After revising the plan, the Commission resubmits it to Louisiana's Governor for approval and to the Secretary, who must approve or reject it again within 90 days of the revision.
