16 U.S.C. § 410xxx — Ste. Genevieve National Historical Park
submitted 8 years ago by Pub. L. 115-141 to r/title-16-CONSERVATION · 1,031 words · no verdicts yet
This law creates the Ste. Genevieve National Historical Park in Missouri once the Secretary of the Interior confirms enough land has been gathered and a written land-management agreement is in place. It sets the park's boundaries, lets the Secretary buy or accept land and sign agreements with property owners, and requires a management plan. But the Secretary cannot take over running the whole historic district financially.
(a) Definitions: "Historic District" means the Ste. Genevieve Historic District National Historic Landmark, shown on the Map. "Historical Park" means the park this section creates. "Map" means a specific map titled "Ste. Genevieve National Historical Park Proposed Boundary Addition," numbered 571/177,464 and dated September 2021. "Secretary" means the Secretary of the Interior. "Special resource study" means a named 2016 study of the area. "State" means Missouri.
(b) Establishment: (1) The law creates the Ste. Genevieve National Historical Park in Missouri, as part of the National Park System, to protect and explain French settlement, traditional building styles, and community and farm life connected to Ste. Genevieve. (2) But the park doesn't officially exist until the Secretary decides that: (A) enough land has been gathered to make the park workable, and (B) the Secretary has signed a written agreement that land owned by the State, the City of Ste. Genevieve, or others inside the Historic District will be managed in a way that fits the park's purposes.
(c) Boundaries: The park's boundaries are whatever the Map shows.
(d) Availability of Map: (1) The Map must be on file and available for the public to view at National Park Service offices. (2) The Secretary may fix clerical or typing errors on the Map.
(e) Acquisition authority: (1) The Secretary may acquire land inside the park boundary, or any nationally significant property named in the special resource study within the Historic District, by donation, purchase (with donated or appropriated money), or exchange. (2) Whenever the Secretary acquires property in the Historic District this way, the park's boundary must be updated to include it. (3) The Secretary may accept, as a donation, land owned by the City of Ste. Genevieve and used as the park's visitor center, shown on the Map as "Proposed Boundary Addition" — and once acquired, the boundary must be revised to include it. (4) The Secretary may buy (from a willing seller) or accept a donation of up to 20 acres near the park for administrative buildings.
(f) Administration: (1) The Secretary runs the park under this section and the laws that generally apply to national parks, including specific listed sections of Title 54. (2) Within 3 years after money is available, the Secretary must write a general management plan following section 100502 of Title 54, and once it's done, must send it to the House Natural Resources Committee and the Senate Energy and Natural Resources Committee. (3) The Secretary may run tours and education programs at other historic and cultural sites in the Historic District connected to the park's purposes.
(g) Cooperative agreements: (1) The Secretary may give technical help and sign agreements with owners of nationally significant property in the park or Historic District, to identify, mark, interpret, improve, and restore it. (2) Any such agreement must let the Secretary (through the National Park Service Director) reach public parts of the property at reasonable times, to give tours and explain the site to the public. (3) The federal government's share of any project's cost cannot go over 50 percent, and the rest can come from donated property, goods, or services (fairly valued), not just cash. (4) No changes can be made to the property or project unless the Secretary and the owner both agree. (5) If the property or project is later converted, used, or disposed of in a way that goes against this section's purposes, the owner must repay the United States — either the amount the government spent, or the added value the government's money created, whichever is more, valued at the time of the conversion or sale.
(h) Limited role of the Secretary: Nothing here lets the Secretary take on full financial responsibility for running, maintaining, or managing the whole Historic District. His role stays limited to what this section specifically allows.
