16 U.S.C. § 428l — Acquisition of lands; agreement for transfer of jurisdiction

This section explains how the Secretary of the Interior can get the land designated for addition under section 428k. The Secretary may acquire non-federal land and land interests in that area by purchase, by donation, by purchase using donated funds, or by any other method the Secretary believes serves the public interest. There is one exception: the Surrender House and the land it sits on can only be acquired by donation or by purchase using donated funds — not by regular purchase or condemnation. Separately, some of the land in the designated area is run by the Army Corps of Engineers, part of the Department of the Army. For any of that land above contour elevation 369 that has been designated for inclusion in the battlefield under section 428k, control can transfer to the Secretary of the Interior — but only if the Army Corps agrees, and no money changes hands in the transfer.
