16 U.S.C. § 583b — Establishment of sustained-yield units to stabilize sale of timber and forest products
submitted 82 years ago by ch. 146 to r/title-16-CONSERVATION · 162 words · no verdicts yet
This section separately authorizes the Secretary of Agriculture and the Secretary of the Interior to establish a "sustained-yield unit" when a community depends mainly on sales of timber or other forest products from Federal forest land and the usual selling procedures cannot effectively maintain the community. The Secretary may define the benefited community's boundaries and sell timber from the unit without competitive bidding, subject to conditions and a minimum price.
The Secretary of Agriculture and the Secretary of the Interior are each separately authorized to act when, in that Secretary's judgment, maintaining one or more stable communities mainly depends on selling timber or other forest products from forest land owned or administered by the Federal Government, and the community or communities cannot be kept stable effectively by using the usual procedures for selling those products. The Secretary may then establish, by a formal declaration and for the purpose of maintaining the stability of that community or those communities, a "sustained-yield unit" made up of forest land under that Secretary's jurisdiction. This section does not define "sustained-yield unit." The Secretary may determine and define the boundaries of the community or communities for whose benefit the unit is created. The Secretary may also sell federally owned or administered timber and other forest products from the unit without competitive bidding, but only subject to the conditions and requirements the Secretary considers necessary, at prices that are not lower than the products' appraised values, and to responsible purchasers within the community or communities.
The Secretary of Agriculture and the Secretary of the Interior are further severally authorized, whenever in their respective judgments the maintenance of a stable community or communities is primarily dependent upon the sale of timber or other forest products from federally owned or administered forest land and such maintenance cannot effectively be secured by following the usual procedures in selling such timber or other forest products, to establish by formal declaration for the purpose of maintaining the stability of such community or communities a sustained-yield unit consisting of forest land under the jurisdiction of the Secretary establishing such unit, to determine and define the boundaries of the community or communities for whose benefit such unit is created, and to sell, subject to such conditions and requirements as the Secretary believes necessary, federally owned or administered timber and other forest products from such unit without competitive bidding at prices not less than their appraised values, to responsible purchasers within such community or communities.
