Design protection starts on whichever happens first: publication of the registration or the design’s first public availability as defined in section 1310(b).
Protection for a design under this chapter begins on the earlier of the date the registration is published under section 1313(a) and the date the design is first made public as section 1310(b) defines that term.
The protection provided for a design under this chapter shall commence upon the earlier of the date of publication of the registration under section 1313(a) or the date the design is first made public as defined by section 1310(b).
