This section makes it a crime to willfully use the listed military forces as a posse comitatus or to execute laws, unless the Constitution or an Act of Congress expressly authorizes it. The punishment is a fine, up to two years in prison, or both.
Anyone who, unless the Constitution or an Act of Congress expressly authorizes it, willfully uses any part of the Army, Navy, Marine Corps, Air Force, or Space Force as a posse comitatus or otherwise to execute the laws may be fined under title 18, imprisoned for up to two years, or both.
Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army, the Navy, the Marine Corps, the Air Force, or the Space Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.
