This section gives an alleged victim a chance to address the danger posed by a defendant when a court decides pretrial release or release conditions under § 3142.
In a § 3142 proceeding about whether a defendant charged under this chapter should be released before trial or what release conditions should apply, the alleged victim must have an opportunity to be heard about the danger the defendant poses.
In any proceeding pursuant to section 3142 for the purpose of determining whether a defendant charged under this chapter shall be released pending trial, or for the purpose of determining conditions of such release, the alleged victim shall be given an opportunity to be heard regarding the danger posed by the defendant.
