This section identifies softwood lumber products covered by the importer declaration program and lists products excluded or excepted. It also sets detailed size, shape, origin, packaging, and home-kit conditions for exceptions.

(a) Covered products include lumber under HTS subheadings 4407.10.00, 4409.10.10, 4409.10.20, and 4409.10.90, including coniferous wood over 6 millimeters thick; continuously shaped coniferous siding, other coniferous wood, and flooring; and drilled, notched, and angle-cut lumber. They also include products under 4409.10.05 continuously shaped along an end or side, and, unless subsection (b) or (c) excludes them, stringers, radius-cut box-spring components, fence pickets, truss components, pallet components, and door or window frame parts under the listed HTS subheadings. (b) Excluded products are trusses and kits properly under 4418.90, I-joist beams, assembled box-spring frames, pallets and kits properly under 4415.20, garage doors, edge-glued wood properly under 4421.90.97.40, complete door frames, complete window frames, furniture, temporarily imported articles claiming the listed HTS duty exemption, and household or personal effects. (c) Exceptions are: (1) stringers with at least two equally placed side notches for forklift blades and proper classification under 4421.90.97.40; (2) individually packaged box-spring kits containing two wooden side rails, two wooden end or top rails, varying wooden slats, and rails radius-cut at both ends, with exactly the listed components, no further processing, and no component over 1 inch thick or 83 inches long; (3) ready-to-assemble radius-cut box-spring components no larger than those limits, with substantial radius cuts at both ends that completely round one corner; (4) ready-to-use fence pickets under 4421.90.70 no more than 1 inch thick, 8 inches wide, and 6 feet long, with identifying finials or decorative cuts; dog-eared pickets must have corners removed as isosceles right triangles with sides at least three-fourths inch; (5) U.S.-origin lumber sent abroad only for kiln drying, planing to smooth-to-size, and sanding, if the importer proves to Customs and Border Protection at entry that it originated in the United States; (6) U.S.-origin lumber or products if the importer, exporter, foreign processor, or original U.S. producer proves at entry that it was first produced in the United States; and (7) lumber in a single-family home package or kit, regardless of HTS classification, if the importer declares that the package contains all pieces specified by a plan for a home of at least 700 square feet; contains the listed doors, windows, fasteners, glue, subfloor, sheathing, beams, posts, connectors, and any contract-included decking, trim, drywall, and shingles; was sold before import to a U.S. retailer under a valid contract for the particular plan signed by an unaffiliated customer; and will be used only for that home, whether entered once or in multiple shipments. For every such entry, the importer must keep and provide on request the matching plan, the signed purchase contract, a parts list matching the plan, and, for multiple entries, the items in each shipment. (d) The President must use these article descriptions when deciding whether a product is covered.
